Terms of Service & Facilitation Agreement

1. Acceptance of Terms

By accessing or utilizing our website (vantishealth.org), submitting diagnostic records, requesting clinical second opinions, or engaging our concierge logistics services, you ("Patient", "User", or "Client") agree to be legally bound by these Terms of Service and all incorporated documents, including our Privacy Policy, Medical Disclaimer, and Refund & Cancellation Policy.

If you do not accept these terms in full, you must immediately cease using this website and our facilitation services.

2. Nature of Concierge Facilitation Services

Vantis Health provides administrative, logistical, and communicative coordination between international patients seeking medical procedures and accredited healthcare providers in India. Our services include:

• Facilitating the secure transmission of patient medical records to credentialed partner hospitals.
• Coordinating preliminary doctor opinions and estimated treatment cost range documentation.
• Assisting with Indian e-Medical Visa invitation letters and official embassy documentation.
• Arranging airport transfers, multilingual translation support, and local hotel/recovery resort accommodation.
• Providing dedicated on-ground patient coordinators during your hospital stay in India.

3. Independent Status of Healthcare Providers

All hospitals, surgical centers, specialists, lead surgeons, diagnosticians, and medical practitioners listed on or introduced through Vantis Health are independent contractors and third-party healthcare entities. They are NOT employees, agents, joint-venturers, or partners of Vantis Health.

The selection of your treating physician and hospital is solely your informed personal choice. Vantis Health does not exercise control over clinical decisions, surgical techniques, diagnostic procedures, hospital sanitation, or post-operative care administered by partner medical institutions.

4. Patient Representations & Obligations

By engaging Vantis Health, you explicitly represent and warrant that:

1. Record Accuracy: All medical history, diagnostic reports, imaging scans, medication lists, and allergies provided to us are truthful, accurate, complete, and un-altered.
2. Travel Clearance: You have consulted your primary home physician and obtained fit-to-fly clearance for long-haul travel prior to departure for India.
3. Medical Travel Insurance: You are strongly advised to secure comprehensive international medical travel insurance covering trip interruption, emergency medical evacuation, and potential surgical complications.
4. Visa Compliance: You are responsible for obtaining and maintaining valid passports, e-Medical visas, and companion visas required by the Government of India.

5. Clinical Opinion & Cost Estimates

Pre-arrival medical reviews, opinions, and treatment estimates provided through Vantis Health are preliminary, advisory, and non-binding. They are generated based on remote medical file analysis prior to in-person clinical examinations.

Upon your physical arrival at the chosen Indian hospital, the attending specialist will conduct comprehensive diagnostic evaluations. The treating hospital reserves the absolute clinical right to revise, modify, or add diagnostic tests, surgical plans, or medication regimens based on your actual clinical presentation.

6. Financial Policies, Zero Markup & Direct Settlement

Vantis Health adheres to strict zero-agency-markup pricing transparency:

• Direct Hospital Billing: All medical procedure invoices, hospital room charges, surgeon fees, and pharmacy costs are issued directly by the hospital finance department under regulated hospital rate cards.
• Concierge Retainers: Any separate facilitation fees charged directly by Vantis Health for non-medical logistical arrangements (e.g., dedicated private transport, local SIM cards, recovery suite rentals) will be itemized transparently in writing.
• Payment Currency: Currency conversions displayed on our website are provided for reference only; final hospital settlements are finalized in United States Dollars (USD) or Indian Rupees (INR) at prevailing official exchange rates.

7. Complete Waiver of Medical Malpractice & Limitation of Liability

To the maximum extent permitted by applicable law, Vantis Health's total aggregate liability for any administrative, logistical, or breach of contract claim shall be strictly limited to the total administrative concierge fees paid by you directly to Vantis Health in the six (6) months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Vantis Health Private Limited, its officers, directors, employees, and representatives from and against any third-party claims, liabilities, damages, losses, expenses, or legal fees resulting from:

• Your breach of these Terms of Service or provided false medical records.
• Your violation of any laws or regulations of your home country or India.
• Your dispute with any third-party hospital, airline, hotel, or insurance provider.

9. Intellectual Property

All content on vantishealth.org, including text, graphics, logos, calculators, article database, and software code, is the exclusive intellectual property of Vantis Health Private Limited and protected under international copyright and trademark laws. Unauthorized scraping, reproduction, or redistribution is strictly prohibited.

10. Governing Law, Dispute Resolution & Arbitration

These Terms shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or our services shall first be submitted to good-faith mutual conciliation for thirty (30) days. If unresolved, the dispute shall be referred to binding sole arbitration in New Delhi, India, under the provisions of the Arbitration and Conciliation Act, 1996. The proceedings shall be conducted in the English language.

The courts of competent jurisdiction located in New Delhi, India shall have exclusive jurisdiction over any legal matters arising hereunder.

Vantis Health reserves the right to modify or update these Terms of Service at any time. Continued use of our platform following published revisions constitutes acceptance of the modified terms.
